Karai & 7 others v Mucheke (Environment and Land Appeal 22 of 2019) [2025] KEELC 6623 (KLR)
The bottom line
#Kenya's Environment and Land Court threw out a land fraud ruling and ordered a retrial because the defendants were never allowed to testify.
What this practically means
#Executive summary
#Questions the Court framed
#The issues the Court set itself to decide, in its own words.
- 1.Whether the trial court gravely erred in declining to allow the appellants' plea to testify after they had initially proposed that only two of them would testify on behalf of the rest
- 2.Whether the respondent's suit was statute-barred
- 3.Whether land parcel numbers 2696, 2583, 7580, 5477, 7332, 3299, 4471, 1775 and 857 located in Amwathi/Maua Adjudication Section were subdivisions fraudulently created out of land parcel number 1984 belonging to the late M'Mucheke M'Aluma
Key legal issues
#Right to be heard where the trial court declined to allow defendants to testify
The trial court gravely erred in refusing the appellants' plea to give individual evidence; their initial proposal that only two would testify was never adopted as a binding court order
All nine defendants were entitled to tender evidence. The proposal that only two testify was not condensed into a court order. The defence was not seeking an adjournment or fresh witness statements - they had already filed and served them. Refusing their testimony denied them the chance to explain how each obtained their registrations, breaching Article 50 fair-hearing guarantees in a land dispute.
Whether the impugned parcels were fraudulently created out of parcel 1984
Not determined; the finding on the fair-hearing error rendered the other issues otiose
Having found that the trial court erred by refusing to hear the defendants, the court ordered a fresh trial and deliberately declined to pronounce itself on limitation, fraud and non-joinder so as not to prejudice the parties before the retrial.
Legal principles established
#- A first appellate court must re-evaluate the whole evidence and reach its own independent conclusions
- Denying defendants who had filed pleadings and witness statements the chance to testify violates the tenets of a fair trial under Article 50
Court orders
#- 1.The trial proceedings and the judgment rendered on 31/12/2018 in Maua CMC Civil Case No. 79 of 2011 are set aside wholly
- 2.A fresh trial shall be conducted by a different magistrate
- 3.Parties shall bear their respective costs of this appeal
The bench
#One judgment of the whole court — no separate or dissenting opinions.
Wrote the judgment
- On appeal from
- Senior Resident Magistrate's Court at Maua
- Maua CMC Civil Case No. 79 of 2011
- Jurisdiction invoked
- First appellate jurisdiction over the Senior Resident Magistrate's Court (land and environment dispute)
Relief refused
#Pronouncement by the appellate court on the remaining issues (limitation, fraud, non-joinder)
The court declined to determine the remaining grounds because a fresh trial was ordered
Costs
Parties shall bear their respective costs of this appeal (no award of costs due to the error committed by the trial court).
Quotable passages
#Verbatim from the judgment, each located to the page it appears on in the official PDF — so these can be cited and checked directly.
In my view, the manner in which the trial court exercised discretion violated the key tenets of a fair trial in Kenya's civil legal system.
There was no dispute about the fact that they had, at the commencement of the defence hearing, proposed to have only two of them testify on their behalf. Their proposal was, however, not adopted by the court and condensed into a binding court order by the court.
The trial proceedings and the judgement rendered on 31/12/2018 in Maua CMC Civil Case No. 79 of 2011 are set aside wholly.
Fresh trial shall be conducted by a difierent magistrate.
Issues in the judgment
#The judgment inconsistently lists the impugned parcels; the issues paragraph repeats 7332, 3299 and 4471 and writes 2583, unlike the introduction
The defence statement of 8th defendant Stanley Thiane refers to parcel 957 where 857 is meant
Article 50(1) is reproduced in a form that does not correspond to the actual text of the Constitution
